This morning at approximately 10:59 a.m., the Plaintiffs filed a Notice of Non-Suit without Prejudice pursuant to Rule 162. The non-suit covers all claims asserted in the referenced cause. We assume the Court will shortly enter an order granting the non-suit.
However, while that non-suit may currently moot the Motion for Summary Judgment which the Court has under advisement, it does not resolve the case. The Defendants have pending a counterclaim for wrongful injunction and pleadings requesting sanctions against Tekola Mekonen and Tsehaye Tsidk Betemariam which we will continue to prosecute. Accordingly, the Court will continue to enjoy plenary jurisdiction until these remaining matters have been resolved.
